Petition for I-140 backlog in CSC

I would like to have a petition for I-140 backlog. There are a lot of people waiting in queue for more than 1 year waiting for I-140 to be cleared. As per new USCIS law, they will not adjaculate I-140 till I-485 processing is complete. I-485 is taking anywhere 24 - 36 months. The candidate is not allowed to change jobs as I-140 needs to be approved in order to use AC 21. If for some reason, the candidate loses his job, he lost his whole green card process.

We want to fight against this Injustice of USCIS CSC. Please put up a petition so that all effected people can fill it up.

With respect I state that the processing of I-140 has been backlogged in CSC for more than 1 year for EB2 and EB3 filers. As per new law for concurrent filing for I-140 and I-485, the cases will be adjaculated concurrently. Since I-485 is taking anywhere between 24 - 36 months to process, not adjaculating I-140 before hand will not allow candidates to use AC 21. If for some reason, the candidate loses his job, he lost his whole green card process.

We, as immigrationportal community request you to please expedite I-140 processing so that it will give required relief to I-140, I-485 concurrent filers so that they can change their jobs while waiting for I-485 approval.

Take the initiative and gather up the troops, I am sure the usual suspects will support any valid proposal you have. It is just that you have to make the effort to move something you believe in. You cannot expect others to do that for you.

I would like to have the petition like we have today for I-485 on www.immigration.com where people can go and sign their greviances. At the end of certain time, this petition will be forwarded to USCIS.

I can bring my troops together but I don't have an umberalla under which I can bring them together. Just by posting that we need to fight against USCIS is not going to help. So somebody has to take the initiative.

I have taken the initiative to have a petition on www.immigration.com for I-140 backlog which should be forwarded to USCIS after certain time. I have suffered a lot in my labour processing which took me nearly 2.5 years in California.

Please help me in drafting petition request. I have already posted the letter I think should be sent to Director, USCIS. Let me know if I need to do something different.

I appreciate your initiative for the I-140 backlogs petition. To come with a good petition for backlogs I suggest you go through this

That gives you an idea about how much effort is needed to come with a petition.

I would say its better to start a thread in I-140 CSC forum and invite other I-140 members to participate in the prepartion of the petition. It may take one or two weeks but that gives you an idea of who is interested to work with you and whether you can mobilize enough people sign for the petition. If necessary start a poll to see how many are willing to sign the petition. Once you have powerful petition, contact Mr. Rajiv S Khanna to host the petition on the site.

If you want, once you a draft version of petiton, may be some senior members in I-485 forum like Kasmir, 140_takes_4ever help you to finalyze the petiton.

Can you commit yourself to drive I-140 backlog petition even after you get your own I-140 approved ?

CSC has limited resources.
I think CSC would have to move its resources from I-485 process to I-140 process in order to improve I-140 process.
If you could succeed on I-140 petition, you might get your I-140 approved soon, but I-485 process might slow down a little.

As I-485 process has been recently improved, most of I-485 applicants don't care about such a petition nor fax/e-mail campaigns.
I believe, if you can push I-140 backlog petition strongly now, you have a chance to get enough resources for I-140 process at the CSC in near future.

Thank you for your advice. I will try my best to push for I-140 as people are not able to change jobs. Let's see how I got the response back from the community.
