Permit and POE Entry Question...

Hi~ I have been reading some past threads/recent threads about RE permit. I am wondering this:

Spouse (GC Holder- marriage) and self (USC) left the country on Sept 5 and we returned back on October 15. His father is not doing so well medically at all-we may go back next week probably until Xmas (tentative). He/we were thinking to apply for the RE permit this week since we are pretty sure this may be how our lives are for the next while. To be honest, my spouse mentioned to me he sort of wants to be able to POSSIBLY do this until his dad passes. The Dr. Already told him recently not to be surprised if he just does not wake up one day(he is declining even more than thought)-yet he is a fighter.

So, if we apply for this RE permit this week-obviously the fingerprints, etc do not occur till they schedule the appointment-so he would have to return I am guessing before Xmas time/our intended time back

Questions:
1. Does one get a hassle ever at the airport when coming back for the biometrics/appt?

2. Do you explain to the agent (if it comes up) that you have applied for said Permit when you are at the POE and you are here for the fingerprints?

3. My understanding is that you apply for the permit and you actually TRAVEL on this document insread of the GC. So-if you get a 2 year permit is THIS what you use regardless if you are starting to spend more time IN The US once again-in other words, can you revert to just using the GC even with a RE permit?

4. On the first stint, we did buy one way tix from US to desitination and then when returned back here also bought one way back to the US. We do this realistically because I hate to pay change fees-astronomical of late. Anyway, is our buying of one ways like this creating an unforseen problem? Really it is due to not knowing in STONE return dates....

Thanks...I guess I was thinking about the RE permit and don't want hassle. The reason we decided not to already apply for one (from the 5 week trip) is because we were not sure of the dad's real condition or if he just looks worse than he is. But really he weights less than 100pounds and although sharp mind, physically(terminal) really doing poorly. My spouse even mentioned waiting till Xmas to apply once again (our next trip (hopefully) back)....but I was thinking maybe it is better to just apply now. His reasoning being to see how 'dad' is doing and if this will continue to be necessary. I vote for applying for it now....to avoid headaches...
 
I guess I could really just ignore your obnoxiousness, but I am finding it really difficult to and choose not to....But for the record, no, I did not get specifics to these 4 questions and I am now ready to proceed. Don't read my posts nor answer if you don't like them. Another person may have the same or similar question.

And maybe USCIS can test people for the proper usage of the English language before just giving citizenship so easily. Your skills need improvement---"didn't we went through this".

If you are contributing to American society as well as you contribute to the board here, then America is in for a rough ride. Congratulations on adapting that Ugly American attitude that one hears people speak of. Either that or you are just a miserable person.

You are right, you should have just ignored, this "Miserable Person" now really regrets taking the time out and answering your silly questions before.
I think the only person that is in for a "Rough Ride" is your poor husband with you, may God bless him and give him strength do deal with a fussy spouse.
Your previous posts suggested that you were a person with high level of intelligence and integrity but your questions here today and before have proved otherwise.

1. Why would anybody be hassled at AP for coming back for a Biometrics appointment, specially when you are coming back within few weeks of leaving US, last time I checked America was a free country for LPR's to travel freely for short absences.
2. If asked, why one would like to hide the fact and not disclose that you are coming to US to abide by a US law to get a RP for extended out of country stay and are coming to comply with a FP request as a part of RP application process.
3. If you are coming to US after less than a year why would you use a RP anyway not that you can't but it is to be used for over a year but less than 2 years of out of US stay and you know about this and more from your several inquiries in previous threads.
4. Lot of people buy O/W Tickets, it is only a issue for non immigrants and is not a deal breaker for LPR's and Citizens. Besides there are several airlines going to India that allow a change in return dates if there is enough time in the return flight.

Please do contact USCIS and quote my short comings of English and ask them directly that they should be more vigilant is granting Citizenship and "Just not give citizenship so easily". I am sorry to not assume that this board may be blessed with perfectionists and answered casually.

Lastly you are thrifty and so is everyone else here including me who also wants free advice/suggestions, but please remember people deserve respect and need not to be attacked personally about their citizenship, patriotism and contribution towards American society specially when they are the one investing their time to enlighten people with real concerns with their knowledge and best of their ability and really are contributing. Whatever i said here was in reply to what you said as you are the one that have started all this non sense.

1. Very unlikely in your case ... you haven't been warned before, and you haven't (yet) built up a pattern of 2+ years of spending very little time in the US.

2. Yes, explain that and show the FP notice and you should get in.

3. If your absence is under 1 year, you have the option of showing either the RP or the GC or both at the port of entry, but if your trip is over 6 months, or was preceded by several long trips outside the US, it would be advisable to show the RP to prevent the hassle.

If the trip was 1 year or more, you must show the RP, but showing the GC is not mandatory because the RP by itself if is sufficient to enter the US. However, most people just show both anyway.

4. One way tickets are no problem. The problem is with having return tickets that end up outside the US.

Even though the RP is not mandatory for trips under a year, the RP can still be very helpful for preventing hassles at the POE if your trip is over 6 months, or if you have taken a string of back-to-back trips, or if you have been given a warning before about prior absences.

Sorry to really cloud up the board with negativity....but~

Name Check-I don't do' it' to everyone but I find it rude that one cannot ask a question without having others (yourself) pipe in with a condescending attitude. People are here to learn and get advice. The questions I asked were very reasonable to me and I am sure others, and possible scenarios (ie scenarios, harrassment). I have many non Us citizen friends as well as a few GC holders and I have seen harassment for no reason. Everyone here I am sure can attest to the 'bright' POE officer.

To respond to your #1-4

1. Last time you checked all LPR are free etc etc. Sure they are to a point but when you are spending more time out they start to question you-even for a valid reason. Better to be prepared.

2. Where did you get the idea I would hide applying for the RE permit from a POE officer. I was just wondering if it should be explained pre-emptively or wait till they bring it up. No biggy just asking. I am a straight arrow.

3. I would apply for the RE permit because I was advised to, by a good lawyer knowing our circumstance, AND I have no idea when my FIL will pass but it will be in the near future. That future could be 1 month to 2 years we don't know. My family is choosing to be together therefore we ALL will be out of the US for extended periods-creating question marks for most POE officers. Again, a scenario of better safe than sorry-Any POE officer could decide that we don't intend to live here. We do plan to go back and forth as much as possible in this duration.

4. One ways? Well sorry but the airlines that I use for direct flights ALL charge at least $100-150 change fee PLUS the difference in price. That is alot to me for a family. I would rather the one way as long as no ramifications-which appears there are none.

You are right- I should not attack anyone for anything-I actually normally don't and my post would show otherwise. Thanks for the reminder of 'everyone deserves respect'. Practice what you preach. It appears you had a lapse-hopefully temporary.
