To start with I am sorry if I posted this in the wrong place. My girlfriend is a legal permanent resident from Australia she was married years ago to a us citizen they had two children. They have been divorced for about six years she went back to Australia about a year ago but she returned with in a year. I don’t think she ever reported getting divorced. Her permanent residence card is up in jan 2009 I am sure we will be married before then. Her relationship with her ex-husband is very tense over the kids and her seeing me. He is telling her that if she will not do what he says and leave the kids with him he is going to file some kind of charges against her like assault. There is no way the charges would ever hold up. But she thinks that if he even files the charges that she will be deported without even investigating the charges. my question is even thought she is divorced she is still a permanent resident so any charges would be a law enforcement issue not an immigration issue is this correct

That would be correct, so long as any charges do not result in a conviction.
