My husband and I were married in 2009 and he now has his two year permanent resident card. I wanted to know if I divorced him before the two years were up, would he have to go back to his country? I am curious because I feel he has used me for the green card, and he has cheated on me. Any help???

Yes, he will have trouble getting a Permanent GC if you divorce him specially if you divorce him because of him not being faithful and his infidelity, he has conditional GC at this time and will only be able to get a permanent GC after your divorce through a waiver if he proves he was not at fault for divorce and did not entered the marriage to evade the immigration laws of the United States by clear and convincing evidence to USCIS.

And to answer the question, yes he will be in trouble if he is not still married by the time he removes the 2 year residency.

n individual who obtained a Green Card through marriage and came to the U.S. on a K1 visa, probably received a Conditional Permanent Resident card that is valid for two (2) years. When this two-year conditional period ends, the permanent residence status automatically expires and the applicant may be subject to deportation and removal. To avoid this, 90 days or less before the conditional residence expires, the applicant must file Form I751, Petition to Remove the Conditions of Residence. Once approved, the conditional status will be removed and the applicant will receive their new Permanent Resident card that is valid for 10 years.

If Your Husband Can prove that he entered in to the marriage with true intentions, he will be given a Permanet GC . Eg: Pictures of big wedding with lots of family menbers, Joint bank accounts, lease documents, Insurance policy, Joint tax returns, Written statements form friends stating that the marriage was in true intentions,
If he can submit all of these documents and may be more , you never know, He might get through. Dont be in a rush to apply for divorse, I think if you apply, he can always say that he loves you and you are the bad person cheating on him to the USCIS officer when he goes for removal of Conditional GC.
