Permanent Residence Questions.

Hi,

I am in currently on H-1 and my company has filed for my Green Card which will take a long time to come. In the meantime I am thinking of getting permanent residency for Canada. In this regard I have a few questions:

1. Can I commute from Canada to the U.S. on a daily basis for work on an H-1 visa (Basically I want to live in Sarnia, Canada and travel to work at Buffalo in U.S. where my company is) ? Is it legal from Canadian as well as U.S. standpoint or not?

2. When my employer filed for my green card, I have an Indian passport. In case by the time my green card comes and I become a Canadian citizen, will it be OK to get the Green card on a Canadian Passpot even though at the time of labor certification of the Green card the I have filled up the citizenship as India?

3. Any idea as to how much time it is taking to get the Canadian residency nowadays?
 
Will Canada PR affect US green card?

Hi, Applied Canada PR in June 2002, so I guess they will assess my application in the next a few months. My 485 is still pending.

Anyone knows if Canda PR application will affect my US green card application? Or at which stage it will affect? Is there any way I can get both Canada and US PR status? Thanks.

------ NO, it is US matter, but it will be difficult to maintain the Canada PR and US PR you can not be PR of both the country at the same time, you have to surrender Canada PR or US GC at some time or the Canada immigration or US BCIS will revoke the one when caught. You can surrender Canada PR after you get US GC

Hi All,

I am in a strange situation to say the least....would like the general opinion from folks.


I-485 concurrent application pending for 6 months - I-140 approved (may 19)- EAD & AP Approved & valid.

My company had moved my job to canada. And they are offering me a job in canada.

Best case scenario for me is to move to canada for some time (may be a year or so- for CAREER and PERSONAL reasons) and then move back to US.

I was told that there are two problems i would face

First- If an RFE comes in within that year and I dont have a job in US - then green card is GONE!!!

Second - when I am trying to cross the border - its a tricky situation.
- I will have valid EAD and AP ( i hope)
- but no job in US ( planning to travel for interviews)
- I will defienlty have a Workpermit incanada and POSSIBLY MY COMPANY WOULD HAVE APPLIED FOR PR in canda

when my first case looks straight forward- is my second case legal and advisable .
thanks and anybody sees any other problem than the one mentioned above.
