PERM_Future Employee

How risky is this? i.e. to work in one co and file Labor under PERM from another co. What is the probability of denial?

Thoritically no risk.
Practically it is the same risk you would have filing as a working employee.

99% you are going to have a query. Even I had the same idea this is what the laywer says

A: Not a good idea to do future employee because: 1. likely the company will get audit which will cost big paid and money. 2. your I-140 is risky unless the company can show big net profits to cover your wage which should be at least $72k in MI.
 
The main stickler is the salary under PERM for EB2. There is no clear source for that yet. Im not too sure how your lawyer could've come up with $72k without mentioning a specific position.

This is an interesting point. I am know that it is possible to apply under current system but am not sure if PERM is going to put any restrictions on this.
 
I think every employee has to sign the application under the penalty of perjury. I am not sure of it. Please let me know if you find any information on it.
 
What the "penalty of perjury" means that whatever is written on the form is true. Under PERM, if they have a clause where it clearly states that future employment is not allowed and you sign it under penalty of perjury, then it can be applied. I am positive that there is no such rule in PERM barring future employment.
