Has anyone heard about the PERM processing replacing the RIR processing. Where can one find the latest news on PERM / RIR. Also my company lawyer has informed HR that the PERM will replace RIR which could be as soon as end of this year which means that we would not be eligible for RIR. Also where can one find the requirements for RIR. I have conflicting information about the length of advertisement time and other details.

My opinion about PERM

There is some info in www.murthy.com about PERM....and that would be as much as anyone knows about Perm.


I personally doubt PERM will come up anytime soon...next year is an election year and the Administration will not want to give any impression of making GC process faster or easier.

Even If PERM does become a reality -
- knowing Labor Dept - they will make it even more difficult - probably require more ads,more formalities ultimately sending out more rejections. Only upside would be it would be rejected faster.

My company is ready to go the route I want for this... The options i have is go the basic route or wait another couple of months to advertise and apply RIR or if PERM is out by then to apply via PERM...

What do you guys suggest I do.

If I were to apply NON-RIR, would I be able to upgrade to RIR after all the reqs have been completed? Would it be a refile or an upgrade with the same Priority Date?

Also would it be possible to apply with a different Processing center since my company has an office under that Processing Center's jurisdiction?
 
My attorneys have indicated a strong probability of PERM implementation by November 1. We are trying to apply RIR before that happens, since even though PERM is super fast in processing time, in all likelihood its going to be much more stringent than RIR, and attorneys are advising against waiting for PERM.
 
If I were you I would not wait for PERM.
Apply for Non-RIR and then switch over to RIR - that way you get an early priority date.

If Perm does come up and it is looking good then may be u cud switch over to Perm later....
 
I am not sure you can "upgrade" a Non-RIR application to RIR and get to keep your priority date. You need to withdraw the non-RIR application and file a new RIR petition.

Can we upgrade to RIR from non-RIR w/o losing the priority date ?

My lawyer said that she has to file a new RIR petition and get a new priority date. I could not file in RIR earlier because ads didn't run for the required period before filing for LC and had to settle for non-RIR petition.
Any light on this issue would be of great help.
 
I believe it is only possible for applcations filed before 08/2001

Is this true?

Also how accurate is it to say that "The RIR process will be replaced by the PERM process once all regulations and processes are in place for PERM"

Yep... for the last 3 years now :D
 
According to articles on this topic, once PERM is implemented, it will be the only way to get labor certification. RIR applications may be converted to PERM, with priority date intact, but it will involve additional work, like additional advertising in PERM format etc, to make it suitable for submission into PERM stream
