My LC filing was as of Sep 2005 and I received the rejection letter last week. Apart from other points - my lawyer filed the LC without waiting for the 60 days to be over after SWA posting.
Can I appeal/petition on this front or is this a non-appealable mistake?
According to my lawyer. Post and wait 30 days, then there is another 30 day cool off period. The LC should be filed after the 60 days. Another lawyer I consulted says this is a fatal error and cannot be petitioned. The other reasons for denial seem like clerical errors.
Exactly, it is 60 days from the start of the Job Order, or 30 days from the end of it. How can lawyers make such mistakes? Anyway, I am sure you can wait the 30 days, and refile.
How can he/she refile if perm was filed in Sept 2005? All recruitment has to be re-done. Mistakes like that attorney did are borderline malpractice in my opinion.
