PERM pre-filing. Urgent Help Please.

Hi,

Can I have
1. 2 print sunday addvertisements and
2. 30 days for recruitmenting or waiting period and
3. applied for Prevailing wages
to file PERM?

My employer he did the above mentioned to file PERM labor. Does he need to do anything else?

As I am only taking care of all these things, I am requesting for help and also I do not have access to talk to my employer's lawyer. Help is greately appreciated.

I really appreciate if somebody can spare 5 min of time to answer my question. As I am going to India on an emergency, I am planning to apply for PERM after I come back from India. Hence I wanted to know whether I can file labor through PERM with the above mentioned items or am I missing anything. Since it is very urgent, I am requesting for help. I can never forget your help.

you must place job order with state workforce agency (SWA) responsible for the state in which the work will be performed. Go on www.workforcesecurity.doleta.gov/map.asp to get a listing of SWAs and their contact no. Job order will be enter in recruitment system for 30 days. during this period employer may received calls from local offices referring workers to your job opening or from workers applynig for the position. Employer must document results of recrutitment and give a good reason why us workers has been rejected. Remember the 30 day job order timeframe must end 30 days prior to filling. Since you havent place job order yet. It means 30 day job order + 30 prior filling . 30+30 =60. You need another two months before you can actually fille your perm.
 
PERM Steps

here are the main steps to file PERM.

1. Get the PWD from SWA, which is good for a year.
2. Place a job order within SWA.
3. Place an ad in Sunday Paper.

Now since it can take upto a month to get a PWD from SWA, you can go ahead and publish an ad in the Sunday Paper. You don't have to mention the salary in the paper ad. Once you get the PWD, ask SWA for the job order placement for a month. Your paper ad and the job order from SWA may go parallel, saves sometime. Once you have done all the above 3 steps, you are good to file PERM. Good Luck.!!!!

About to file thru PERM - Need clarification - Urgent

Hi Gurus,

My labor was applied in oct'03 eb3 and now it is with DBEC. I am going to complete my 6 yrs by Jun' 06. Now my vendor is forcing me to join thier company and they would file my labor in PERM EB2.

My question is Can they apply 140/485 without joining them after PERM approval. If so, can I join them after 140 approval by using EAD (assuiming EAD will be approved before 140). The reason for this is I don't want to file H1 again thru them.

I read from this forum that EB2 also may retrogret some time in Sep 05? Is this true? Is there any official
news on this?
