Perm or rir -what to decide

Dear Great Guru,
I applied for RIR labor certification on Oct 2004. Please suggest me whether I sould wait for rir to be approved or should I apply through perm withdrawing previous rir application or apply a new perm application without withdrawing rir application . I am a civil engineer from Bangladesh . My 6th year H1b will end on March 2008.

In the retrogression era ,even one month PD is countable. (Previously people never bother to heed on this point, just bother only PERm approvals)
Do PERM (conversion RIR to PERM) but keep your prioritydate Oct 2004. Once your PERM is appoved apply I 140 only and get it approved.

Once you have I 140 approved, at the end of March 2008 ( 6yr completion) you can extend your H1 another 3 years (upto 9th year). Before that time your date may be currentsince you are from Bangladesh.

Pls advice my case. My EB2 RIR was filed on June 2004 for Senior Software engr position. I am discussing with my attorney to file PERM. According to him, if I file in PERM for the same position, I need to withdraw the original application, which means I will lose the priority date. He talked about filing in PERM under different position (Project manager, which I am now) , as new case, not withdrawing the RIR, which means both can continue. Do u have any suggestion for me as to what is best for me?

One can only use 1 LC from the same company. However, you can apply 100 LC applications. The first one approve, all others will be automatically denied. What do you want to play. If you hope to get LC before EB2 retro, you can apply a new PERM application asap. If you want to save the PD, you should not apply the new PERM, rather to convert the current RIR to PERM (this is a pain process and take a long time almost like RIR)
 
Multiple filing allowed or not

Newbies,

Are you saying this based on DOL's FAQ 5 published on Aug 8th or your lawyer told you that? DOL deleted those patrs from that document later on and yet to give any further direction on multiple filing.

Please let us know about your source for this info.
