perm - high prevailing wage

Hi,

The attorney of the company I work for has submitted the form to get prevailing wage, however, we were given an amount that is way higher than what the company can pay. (About 20K more than what I get today)

The attorney says we cannot suggest an amount on the form in the state of California. We were asking for 1 year experience for the position and we received a Level 2 wage. We did put my current wage to the application form, hoping for a lower amount.

If we take out the experience condition from the job description, it will make it easier for others to be eligible for the position. On the other hand, the salary that I have is about the same as the other analysts' in my company and they can't pay me more.

Can anybody think of any suggestion? Is there way to let Caliornia DOL know that their estimate is very high?

The company wouldn't be paying you higher salary but it should have net income or net current assets for the shortfall, difference between your current salary and 20k excess, the key would be to prove company is financially sound to pay the preoffered salary from the time LC is filed until adjudication of I485

My salary also came very high and the following is the suggestion from my lawyer

"There are various ways we can work this besides raising salary. The most usual method we have seen, for example, is that an employee who receives health insurance through a company plan, instead, is given the money as part of their salary, and then a deduction is made for the health insurance (pre-tax)".

Please comment if any body has any experience!!!!!

As far as I know the only way to lower the prevaing salary is to go with zero experience. By the way, are you trying to apply with BS or MS degree. What is your job description?
 
I have an MS degree, however, BS degree is enough for the job. The job description includes some basic programming skills (writing macros), Excel, Access, and user support. There are also couple industry specific criteria that would make harder for anybody outside of the company to apply for this job.

System analyst level 2 is about $10K higher than what we can afford. However, I couldn't find a position that goes between "system analyst" and "computer user support". We asked for one year experience and they gave level 2 system analyst salary.
 
From experience, if the job description is shorter and less technical, the wage should come back lower. Although, California.... it's hard to work with them to get a good wage. The only point I can emphasize is that the company isn't required to pay you the prevailing wage until AFTER your I-485 petition has been approved... so... if they think they can pay you that wage after all the time has passed, it could be worth a shot.
