PERM for housekeeper ?

Hi,

My neighbor wants to sponsor their cleaning lady/housekeepr (she has a tourist visa now). Is it possible to sponsor a housekeeper through PERM? Is she supposed to be sponsored as an unskilled worker (EB-3) or it is possible to sponsor her as a skilled worker?

It is basically possible (if she is legally working right now). However since she is on a tourist visa she cannot file for adjustment of status. Actually if she works as a housekeeper on a tourist visa it is illegal and she cannot be sponsored at all but CIS would kick her out if they found out. The only way it could be done would be to send her home and apply for GC for a future (unskilled) job. She could then get the GC after approval through consular processing.

Which skill (=degree) does this require? It would have to be in the unskilled category therefore.

But if her visa is valid untill December 20, 2006, she is from Poland, so if the unskilled workers category becomes 'current' (in October) is it possible for her to apply for adjustment of status then (the PERM process would be passed till October) ?

Of course, nobody knows she works in the States :)

There is no tourist visa that's valid that long. Something is strange here. You can try to apply in EB-3 unskilled - but I don't know if that will be current in October again. EB-3 unskilled is not the same as EB-3 skilled.
