PERM for a future position

My lawyer told my employer that we can apply LC for a position that the company is going to offer me in the next couple of years. The reason they want to do so is because my current position doesn't need a master degree but they want to require a MS degree and some other requirements- business necessity. I've read PERM Final Rule but didn't find out where the "future position" was mentioned. Does anyone have an idea?

That's encouraging...
How about a year from now, my employer still has not promoted me to the "future" position and my salary is still lower than the one on the LC application? If we'll ever be audited, would that be a problem?
Thanks!

Hexamon is right - the position and the salary start once the green card is approved.
CIS will not audit what salary you are getting now or a year from now. What CIS will look at is the firm's ability to pay the salary promised for your future job. Current salary may be one of the indicators of this ability. However, this ability to pay is usually determined by the company's assets, turnover, profits, etc.
