PERM Eligibility???

Hi,

I am a citizen of India and have done BS in computer science from US. I have 2 years of work experience in my university/small business internship and 3 years of professional experience. Can I qualify under EB2 category?

All depends on your job offer, not depends on your exp.
 
My employer is ready to do

whatever then can to sponsor my GC. What kind of job offer do they have to make? I talked with one of the lawyers and she mentioned that I am in EB3 and there is no doubt about it. Only after 3 years I can go for EB2.

If the job offer is BS with 5+ yrs experience you will qualify EB2 if you have that qualification and exp, the prevailing wage is much more in this case. Most of the companies may not accept this PW.
 
Does that 5 years can be inclusion of OPT experience + H1B experience or just H1b experience (progressive experience)?

Exp from sponsering comp should not be counted usually. Any exp after graduation can be counted.
