Perm eb2 vs eb3

Hi ,

I am working with my SWconsulting company almost 2 years , now they are started doing my GC processing ,In 2007 I did my Masters degree in information technology and more than 10 years experiance in IT.

Now my employer is saying The advt. which went out for my GC was under the impression that I only had a Bachelors and not a Masters. now they are saying they will be filing My PERM on a EB3 (Bachelors + Relevant work experience) and not EB2 (Masters + Relevant Work experience).

What I need to do now...??
can I tell them to file with EB3 only ??
what impact I may have if I proceed with Master’s even though the ad was based on Bachelors degree. ???

Ok first of all, the POSITION for which your case is being applied is not based on YOU but on the POSITION itself. It is irrelevant if you have a Master's degree if the case requires only a Bachelor's degree.
Furthermore, I can't tell 'when' your Master's degree was obtained from your post, but there is also a question on the PERM petition about if your employer paid for any of your qualifying credentials, so if they helped you with tuition for your Master's and that was required for the position, that's a big red flag.

Bright side: File the LC now, and if your POSITION changes in the future to a position requiring a Master's degree, your employer can start a new PERM case and test the market for an EB2 qualified US worker. If none exists, they can file a new EB2 PERM case on your behalf at a later date.
