PERM: Denied & Request for Review

My PERM application was denied in November 2006.

As per my lawyer my PERM application was erroneously denied by the US Dept. of Labor based upon a misinterpretation of the form that was submitted electronically.

So my lawyer immediately filed a 'Request for Review'.

Does anyone know how long such a 'Request for review' take to process.

I am also in the same situation, my perm got denied in April and my lawyer was not comfortable to file mtr so I hired another lawyer to do so.and according to that lawyer it will take months or even years also don't depend on it and also he said there is only 10% chances of getting approval for these type of cases because its a kellog case. I have not yet came across any case which was denied due to that reason got approved later.
I am so unfortunate that I converted my old tR case in to perm so now I lost my old PD also.:(

Did you mean to say 100% chance or 10% chance of getting approval? Even mine is the same case, case got denied in sept 2006, appealed in oct 2006. Still no luck:mad:

Hi infoseeker47,

My lawyer is saying only 10% and not 100%. I have been searching for cases

which are denied and then in review orreappeal any approvals but I have not

come across a single case which has been approved after mtr. Well BALCA is

very slow in processing these cases. what is your situation could you please

explain?

My case is a bit diff. I did not conver my old case to PERM. I was a first time applicant.
Also what is a kellog case.? My lawyer says that my case was denied due to DOL error.

Also my case is not with BALCA the request for Review has been filed with the PERM processing center.

The Kellog case references the "any suitable..." language.

I have yet to hear of BALCA giving any approvals either, as after they reviewed that first one and denied it, they sent all of the other ones back to certifying officers to look over once more so they didn't have to waste their time with stupid errors like that one (the case I'm referring to was a date case - the person filing it indicated the wrong month on one of the sunday newspaper ads, which caused an automatic denial, as the date referred to was not a sunday. However, on further review, they realized that the sunday ad that was supposed to be referenced was over 180 days old! I.E. Another error would have caused the denial anyway.)

I haven't heard of any requests for review going through. Good luck to you all and please keep us posted as to if you hear anything! I vote it's better to re-file and make the change they want you to do than do a R-4-R, as you can't file a new PERM while the R-4-R is pending.
