PERM certified today!!

I just had to let you all know - my PERM case was certified today but I did the whole application myself. My employer had agreed to sponsor me and I completed all application and all the requirements. Not just that but I only applied as an Administrative Assistant. Now comes the I140 and a long wait for a visa number.............(UK Citizen, EB3 category)

There are five main "queues", if you will. China, India, Mexico, Philippines and Rest of the world. EB3 is retrogessed for all. See the latest visa bulletin.

I am new to this forum and just get starting the long long journey! My employer won't pay lawyer and I am thinking of doing the PERM by myself. I am wondering if you want to share some tips of the PERM application, like where should I get started. is the ads the first step or I should fill the prevailing wage first?

According to my lawyer, you should ask EDD regarding whats the prevailing wage for your current position. I believe there is a form you can fill in to fax to EDD to ask for the prevailing wage. EDD usually take 10 days to get back to you.
Also, there is a website that you can go to to search for your prevailing wage, but more accurate if you ask EDD.
After you get the prevailing wage, you can start the ads.

What if current salary is less than the prevailing wage?

:confused: I am currently already have an approved LC through RIR and I-140 is in process for EB3.

My lawyer suggest that I file a new LC through PERM so this time I can get EB2. But my current salary is $4,500 less than the prevailing wage required for Level II PERM. If my current salary is less than prevailing wage, should I proceed with PERM or should I sit tight and wait until EB3 is current?

I like to know if someone can suggest what are my options? Thanks so much. Any reply or concern is welcome.

PERM rules are very firm on prevailing wages i.e. 100%.

A friend of mine has lower wage than the prevailing wage, but he got LC approve using PERM. His prevailing wage is $33/hrs, but his current salary is $23/hrs. He also got his I-140 approved already come out this month. By the way, he is EB2.

His salary is way lower than prevailing wage and I am surprised to know that not only his PERM is approved, his i140 is also approved in EB2 and that's at $23/hr. You have one heck of a lucky dude right there. :confused: :eek:

DOL and USCIS may not be aware that your friend is actually being paid less than the prevailing wage. The prevailing wage is a mandate to pay the employee that wage. Company can put in the form that will pay the prevailing and in reality pay less. But this is very dangerous for both employer and employee. Should DOL come to the company and make an audit of any sort, not necessarily PERM-related, and finds out they're paying less, the company may be fined and your friend's PERM and I-140 revoked.

In my case, my employer was paying me less than the prevailing wage when we started PERM recruiting and they had to raise my salary to the prevailing wage in order to retain me.

BTW, I think you were in the other forum PERM conversion, or not?
