PERM Approved - I140 as a future employment

Hi,

Some insight on my situation:

I am in my 7th year on H1, labor applied from my current employer (Company A) but no signs of it getting approved in the near future (PD is 3/2001), Due to frustration I initiated the GC process from a different comp (Company B) and they applied labor cert thru PERM and it got approved recently.

I need your advice on, Can I apply I-140 using my newly approved labor cert via (Company B) while still being with my current employer (Company A).

Your advice is greatly appreciated..

Yes you can. GC is for future employment. You just have to make sure you are on this employer's payroll after the GC gets approved
