Hi,

i am in little difficult situation. Can someone tell me what are my option sin below case:

My 6th year of H1B is expiring 31st Dec'06.
My company has not filed my LC yet but now they are ready to file it.
I came to USA 9 months after my first H1B approval.

So can i appply for LC now and somehow i get 9 month extension on my H1B that will give me 1yr of duration of LC filing date (Hopefully) to get extension after my H1b expiry with 9 month extension?

you can recapture

you can recapture the days that you didn't spend in US during your H1B period. Your lawyer should know this already. It will be up to you to prove that you were not in US. Evidence can be passport stamps, flight information such as boarding passes, itinaries or other means. try to gather as much as possible to prove that you were not in US. then you will have 9 more months plus any vacation time you spend abroad.

Means I can apply for LC even my H1B is expiring this dec'06.
I am not very sure about perm things. What should be my priority date? Is this date when our lawyer file the form means lets say if we start process now it should be within 7-8 days right?
