Pending RFE, returning to US on AP

Hello Gurus / Ginnu / RealCanadian

Pls advice. My spouse has been issued on RFE on our marriage certificate and issues on name in passport vs visa's issued.

We are returning to US on APs in a couple of weeks.
Will this pose any issues for my spouse?

Spouse's case status says 'in suspense' until we receive evidence. We have been given time till mid april 08 to respond to the RFE.

I really don't think that there are any issues as such when returning back on an AP. The "in supense" only pertains to the processing status. You are in good shape.

You are fortunate to have your NC cleared and an officer actually looking into your case. What more can one ask for in the current circumstances!

Sigh of relief about teh RFE not affecting our APs / reentry.

I had no idea our NCs are clear. That would be awesome!

I assumed that our cases got 'touched' bcz the processing dates are current for our RD at NSC ( tho' my PD isn't current as yet as per visa bulletin)
