Pending review means APPROVAL?

Hi, there!

As you may remember, I called USCIS about 10 days ago to inquire about my I-485 case pending since August 2005 (NSC is processing applications received on November 1, 2005).

Today I received a letter, which reads "......Your case is pending officer review......". Does this mean that the officer is about to sign the approval letter? Or is this just a "standard" response?

If you have received a similar letter recently, please let me know. I am a little curious :rolleyes: Thanks for your replies!

It means that a human is about to look at your case. In most cases, it mens approval, but it could also result in an RFE. Either way, I would bet that something will happen within 45-60 days.

Breaking News - RFE Received.

As you suggested earlier, USCIS IS working on my case: Today both my wife (beneficiary) and I received an email requesting additional evidence or information. I will keep you updated what the RFE is about, and if it is a serous one, I would like to ask for your assistance. Thanks!

Glad to hear that there's movement. If the RFE is for both yourself and your spouse, it is probably related to medicals or birth certificates - basically something other than an EVL.
 
I got the following response email from USCIS, is it same as pending officer review?

A decision has not been made on your application. It is currently awaiting assignment to an Officer. You will be notified when a decision has been made or if additional information is needed.

Can you please explain how did you managed to receive a email response from USCIS regarding your case status - as from what I understand the only email responses that one receives from USCIS are about any status updates - which anyhow you can view online. So please kindly explain how did you managed to get an email response reagrding your status???

See the bold. It's just sitting in the stack, with the rest of the backlog. No one is looking at it, or about to.

It's strange as I also called up 1-800 # do to a status check a month back - but I was told that I would receive something in mail - still have'nt received anything.

eb1a_2008, can you please specify what options did you select after dialing 1-800 #.

I do not think it's bad news at all - atleast one thing is for sure that there are no pending name or background checks - Hopefully in the next couple of months you might actually get approved.

I used the "POJ" trick that is posted somewhere in this forum:

1) 1-800-375-5283
2) 1
3) 2
4) 6
5) 1
6) EAC # (Listen to the machine till the end)
7) 3
8) 4
9) Rep

The rep gave me a receipt numer and told me that I should receive a response in 30 days. If I don't hear from them within this period, she said that I would need to call the 800 number again with the receipt numer ready. I didn't receive any email regarding my inquiry, nor was there any LUD change. Instead, they sent me a letter. Hi Freeman,

Have you noticed any LUDs on your & your wife's cases prior to the RFE emails?

I also got the same inquiry response (Officer review) from uscis on 8/1 and I see LUDs on mine & my spouse's case on 8/8. 'm wondering what that could be..!

LUD Change

eb3Ind,

There was indeed a LUD change on the same day I received an email. Last night, my wife and I were speculating/debating for a long time what the RFEs will be about. :rolleyes: But at the end we decided to wait and see the RFE letter. I wish your RFE would be an easy one. Keep me posted!

RFE letter received

Today I received a RFE letter from USCIS. To my surprise, it is about continuation of NIW and verification of employment. Even more surprising was that my wife with H-4 visa is asked to provide employment history:


Please submit documentary evidence that you continue...the occupation that is the basis of your national interest waiver. Such evidence may include: a currently dated letter from present employer, copies of recent pubications...

Submit documentary evidence of all nonimmigrant status granted to you since your first admission...also submit evidence that any and all employment since your admission has been authorized. Such evidence may include, but not limited to:

-Copies of Form I-94, I-797 approval, U.S. visas, any EADs...


My questions are: (a) Is this a usual RFE? (b) Do I need to write a cover letter? or, just send copies of all the forms that I have?
