Pending on FBI name check, what else to do?

I'm glad I found this board, very resourceful!!! Thanks everyone!

As for me, guess I'm just another victim of the fbi name check process. :-(

I applied for family-based green card in Apirl 2003 at San Jose, California and had the interview 4 months later. At the interview, I was told that the fbi name check request was sent in May and there's no results returned to CIS, therefore no decision could be made.

Till today, more than 2 years have past, my application is still pending because of the name check. I renewed my EAD and re-did finger prints. Over the past 7 months, I contacted FBI's name check division via snail mail and email, no response. Called many times(202-324-3625, Hardy's office), first they said they were behind on replaying emails, then (in Sept) they said they decided to stop replying emails for 60 days and when I called last week and today, they simply hung up the phone on me and then redirect me to a voice recording telling me to send emails. I also talked with the CIS officer who interviewed me in 2003 twice, otherthan checking the status, he couldn't do anything else.

Meanwhile, I contacted one congress women and two senators, they made inquiries to FBI for me, but all came back with the same answer: STILL PENDING, no estimation of completion date and none of the offices is willing to do anything more.

I guess I pretty much did everything I can, really don't know what else is there to do besides waiting.

Any suggestion/advise would be greatly appreciated. Big Thanks!!

What is your Nationality and timeline? Please do write.

The only way for you to find out when your Name Check was submitted is to receive a reply email from FBI for an inquiry initiated by you. However, the date should be within a week of your FP received noticed on your case status.

You can call FBI at 304-625-5590. This number is for Fingerprinting. You will get to talk to a live person who will ask for your A# and tell you if the FP was received and processed.

Once FP is processed, it goes to FBI.

For name check inquiry, you can call 202-324-2399. This is an automated machine which will tell you how to submit your name check inquiry.

You said "Once FP is processed, it goes to FBI. " does it mean that once you get the i-485 FP doen they are sent to FBI fingerprint check and then sent to name check? Or does i-485 Fp have to do anything with namecheck at all or is it a process that is independent of I-485 FP?

Thanks Piya! My nationality is China, so that might be the reason why it's taking so long. However, I believe it's more likely that my case is just sitting there because somehow the computer determined it's a "hit" and FBI staff just havn't gotten to my file for manual review. :(

I know CIS sent the name check request on me in May 03, because at my interview in August 03, the interviewing CIS office showed me the request paper.

I sent emails inquiries twice to the name check email address since March, no response. Like I said above, in September, they said they would stop the email reply for 60 days, don't know whether it's true or they'll stop doing that forever.

we are on the same boat. from china too. pending since Dec 03. Just be patient and wait (i know this option sounds hopeless). I don't know if filing lawsuit applies for us. i heard only those who is waiting to be citizen can file writ Mandamus for FBI name check delays. correct me if i am wrong.

Well, belle, let's give each other a hug then! :) Yes, I know, waiting is always the thing to do. Btw, I also did the FOIPA things, still no use. Pending on the name check doesn't really affect my daily life that much, so it's more about simply want get the thing done. Let's keep each other posted!
 
can i ask you if your case is in local district office or national benefit center? mine is in local office. no way to check status. if you call their main number (the one on your 485 receipt), they will send email inquiry to the local office for you and ask you not to call in 60 days.

i agree, daily life is going on ok, but it's a pain in the neck to renew EAD every year and AP every time i need to go out of country.
 
My case is in local district office and the thing is i don't even have a receipt number because i submitted my application directly in person at the local office. so yeah, just like ur situation, can't check status directly by calling the cis main customer number.
