Folks..my labor has been filed (regular EB3 LC) in march 2005 and is with Dallas Backlog office.. suppose I find another position within my company that matches the same job title but the job description differs little bit (meaning the position described in LC petition and this new position have a lot in common like the languages used ex.java,vb,perl etc but the petition is for a Mainframe support group and this new position advertised is for a network support group..all within same parent group) Is it possible for me switch to the new job (use my existing petition) or will that be considered as a totally new position and I will have to withdraw my old petition and file for this new position through PERM. Just thinking out loud. my attorney feels that as long as there is a good overlap and the title remains the same we should be ok with the old petition..anyone had similar experience/switched jobs within same company with pending LC approval ? any complications that may occur ?
