Pending I-485 and being arrested

i have a friend that came here on J1 visa then married a US Citizen , during the interview had few problems answering the questions , all i know now its over the time limit on getting a reply to the I-485
the problem is , got arrested for teft and theres no BOND pending INS review ,
Can this person be deported , are there any chances on getting out
Anyone thats being on a simmilar situtation or knows of one please reply

If possible sentence is more then one year - he will be tried, jailed and then deported.

Thou shall not steal.

I think he should be deported regardless. Stealing is not cool mmmkay...
