Pending Court case and travelling on AP

Hi,
My wife is on H4 and we are planning to go to India for vacation. She is having a pending Child abuse case against her, which as per attorney, will be dismissed by the court. Court hearing is on Feb 25, and we are planning to go to India on Jan 1, 08 and returning on Feb 13. We have approved AP and our H1/H4 visas are expired. We have valid I797 and I94, which are valid through June 08.
Instead of getting visas stamped, we are thinking of re-entering US on AP. Can officer create any problem on POE due to pending court case?

best thing for you is to do a quick consultation with an immg attorney or your attorney about this.

usually pending US legal cases may cause issues when entering or leaving the united states...but i suggest you seek professional advice
