Pending Asylum Case in Court

Hi Experts,:confused:
One of my friend has asylum case pending in court since 4 years. His hearing was getting postponed on each date due to one or other reason. Finally, he had his individual hearing before the IJ in dec,07 which went very good. At the end of the hearing IJ told that he can not give his decision because they have not done his background check. So, postponed his decision hearing to June, 08.

His Lawer told him that its a good indication that IJ will grant his case otherwise if he had to deny it then he could have done it without background check. What is your opinion on this?

It should get it. I had the same experience in my court hearing.

Hope your friend get good news when he goes back to court. I still suggest taking the worst case scenario in mind. When my case was in court, I was not given the decision the same day. Even though the interview went well, the judge wanted to go over his notes and also hear the recorded testimony again.
 
if the delays was cos of court order, its then judge will consider making you wait for so long and might grant you.
 
What they do in the background check? Hopefully, the background check should be completed till his next hearing in June. He don't have any criminal background or any arrests. But he didn't pay any tax the year he came to united states because his income was very less. Are they going to check his tax history as well in the background check?
 
no tax issue what so ever in asylum process or case,

tax issue when applying for citizenship after many years of asylum grant.
 
Court has asked a proof of his employment with the last 2 employers. He has worked on a cash with 1 employer. He was helping them in the household work and they were paying him cash. He showed this on his tax return but don't have any other proof. But this employer is agreed to give him in writing that he worked for them.
He worked just one month with other employer and don't have good terms with this employer. He worked on cash for him and employer will not give him anything in writing. What should he do in above scenario? Please suggest because he is really worried about the failure of his case.
 
i have never heared or found a tax issue for asylum case pending in court with a judge.

Why tax issue when the case is not decided? tax issue may come up for any green card or citizenship interview.

my case took 3 yrs and i got from judge within 25 mins and no such tax questions.
