PDs for EB3

My PD is 03/99 (EB3) and my I-140 was already approved. I have 3 years on my H1. Does anybody think I stand a chance of getting GC?

I am actually eligible for EB-2 (I have masters). But my company\'s lawyer applied in EB-3. I should have insisted for EB-2, but I did not. Now I am stuck with EB-3.

If change the job now, can I re-apply in EB-2? Can I caputre my old PD (03/99).

Just having a master\'s degree doesn\'t make you eligible for EB2. Your job requirement should reflect needing a master\'s qualification.

Since you have three more years on H-1 with an I-140 approval for ID:3/99(EB3) you should be able to change to a company that is ready to file you under EB2 with your Master\'s/5 years ex. and change your above ID to EB2.

Here is how it works as I did the same.

I got exactly 3 years on my H-1 when I changed with ID:8/96 EB3 India with approved I-140.

My new company wanted me to wait for 1-year to file C. I waited and after completing 1 year I had only two more left on my H-1. I used the same lawyer and file labor in RI in MD. When he filed I-140 he used my old I-140 and requested to use that ID which was transferred.

Now I am over 6 years limit and on renewed AD. Going for FP on march 6th. I am sure you will get your GC faster by changing to a company that can file for you in EB2. Check with yor lawyer and also note that there are some limits like you have to do similar job in that same geographical area.
