PCC Question

Hi,
My I-140 was approved on Aug 5th and I choosed to go for consular processing .


I did not applied for my PCC certificate yet.


Now my questions are :

1) Is it definite that I should send PCC certificates along with other certificates like Birth, Marriage Certificates to National Visa center or is it okay if I have this PCC certificate by the time of actual interview in Chennai?


2) My 6th year Visa will expire in March 2005, am I now NOT eligible to apply for 7 the year extension as my I-140 got approved?

{You still have time. You can apply for the PCC once you send the
packet 3 to NVC which is a step down the road}

{With few exceptions (Consulates in Canada) all the above documents are
to be carried to the interview. You do not have to send them to NVC}


2) My 6th year Visa will expire in March 2005, am I now NOT eligible to apply for 7 the year extension as my I-140 got approved?

{You are eligible for the 7th year extension of your H1B. It is doubtful
if you can get your interview within the 7 months time you have}

Thanks for such a quick reply Raju .

Could you please provide me a link that states that PCC is not required when we send the documents to NVC ,the reason for requesting , is my attroney want to have this PCC certificate in hand right now to work on my case any further ,i just want to fwd that link to her and save some time or else i am forced to wait until i get PCC .

My wife went to India just 15 days back on Vacation ,if i dont prove my attroney that PCC is not required right now , my wife have to come back from India ASAP .
 
1. You do not have to send your PCC, Birth Cert., Marriage Cert, to NVC. You have to take them with you when you go for your interview.

2. You ARE eligible to apply for 7th year extension, inspite of your I-140 status. You can apply for extension towards the end of this year (actually, 3 months before your current H1B expires is what the regulation says about H1B renewal). But I think if you are prompt in sending your NVC fees followed by your DS-230 forms to NVC, you would get your interview by December this year. So you may not need to extend your H1B.

Sometimes, the lawyers want to be sure of all the documents before proceeding with the case. I believe they are not quite familiar with the 6 mo. validity thing. If the attorney is not convinced, then apply for a PCC and get it. So in my case, I got a PCC and asked the lawyer to proceed and then got another PCC after 4 mos.

For you spouse you can cook up something that it will take 1 mo. to get hers, so please proceed with whatever you have.

I worked in 2 different countries earlier before comming to us.I got the pcc from that country before a year back.....Do you think that the validity of both the coutries is vaild for 6 months?
 
Indian PCC

This is an old question/concern revisited.

Has there been any cases in the recent past (say past 1 year), in which local Indian PCC was asked from people living in USA?

This question arose again, because I was reading some posts of 2003 experiences today, and some people said that they were asked for Indian PCC even though they live in US.

Even anybody knows of any such cases, please post.

The best way to get confirmed for the latest procedings is by sending an urgent mail to the conslate and get the issue cleared. As far as my knowledge goes no one was asked but alren was asked by immigration office about the PCC which is very very exceptional.

immigration office = indian exit point. Although, it was more of a ploy to just harress me.

I belive thte consulate will require a certificate less then 6 mos. old. Although you can verify it with the consulate in concern.
