PCC question

Hi:

I'm actively thinking of pursuing AC140 once my I140 is approved. With this in mind, I've been reading about the requirements for obtaining PCC from HK, where I had stayed in the past. One of the requirement is that:

"A photocopy of a letter from the relevant Consulate / Immigration Authority, which contains applicant's name and clearly indicates that the production of the Police Clearance Certificate is required".

I spoke to them last night and they told me that without a copy of such a letter, they will not entertain any PCC request.

Since I'll be going for AC140, I wonder where would I get such a letter from the immigration authority/consulate. I understand PCC requirement should be mentioned in the interview appointment letter that the consulate will send, but my company's law firm has categorically told me that I've to obtain all PCC certificates before they would file a AC140 case for me to the relevant consulate. This whole thing has put me in a dilemma.

Any help/advice on the issue would be greatly appreciated.

Thanks for your reply. HK does not have any consulates. Nevertheless I do know who/where the HK PCC is issued (check the link below), thats not the problem, the issue is that they are asking for a letter from the immigration authority/consulate that a PCC is needed and since I would be going for AC140, I'll not be having any such letter, therefor I'm in a fix. They told me very clearly over the phone that they will not issue a PCC in the absence of such a letter.

This is definitely a difficult situation. At this point neither the
NVC nor the Consulate would issue a letter addressed to you
saying that production of the PCC is mandatory.

I do not know whether this would work but you can try.

First find out by research where the requests for HK PCCs are
processed.

Then collect the relavant pages from the Consulate web site or
the Dept. of State website where it says a PCC is a required
document.

Have your attorney address a letter to the HK authorities
saying that a PCC is a required document, and requesting them
to issue one for you.

One more thing you can do is to find out more information from
someone who has obtained a PCC from HK. I am sure there
would be someone.

Open a thread with a prominent title like 'PCC from Hongkong..."
or something like that.

It would be great if someone responds and gives some information.

I 100% concur with Raju.

Also in the link that i provided above send emails/ private messages to 'saythanks' id and see if he/she responds.

Also check cptracker.com, identify the folks who have appeared at HK consulate for their interview and see how they got their PCC's.

I just checked cptracker.com and realized HK folks do not have their emails listed but also searched those names on immigration portal and realized that a person by 'jskho' listed on cptracker.com was also a participant on this portal till about 2 years back. So try pm'ing jskho too to get more details!

Thanks for your replies. I did pm a few guys of the forum that had obtained HK PCC in the past but never got any reply. I guess they are past their GC worries and hence may not be checking the messages.

Raju595, my thoughts are exactly on the same line as yours, i.e. I intend to take a letter from my lawyer addressed to the HK police authorities that I need a PCC for my US immigration visa. I hope that works.

One related question, does the letter that the consulate sends confirming interview schedule mentions that a PCC is needed? If it does then it solves some of my worries. But I understand from various postings that the letter is normally received only about 3 weeks before the interview and that time may be too little for HK to issue the PCC and mail it.

YEs one of the pages of the p4 explicitly states that a PCC / basically a letter from police is required clearing the person mentioned of any adverse criminal acts!

AS suggested by raju...ask your lawyer to write a letter to the hk consulate/ police authorities include this form from above link and explicitly state it is a requirement for usa immigration purposes!
