Hi,

A question here: Who should pay the $130 filing fee for an H-1B extension? My employer or myself? I couldn't find any regulation to specify who should be the payer. If I pay the fee by my personal check, would it cause problem in processing? Thanks a lot.

Employer right. But you pay through a bank draft or Money Order anyways. It doesn't matter who makes it you your employer or anybody.

Go to Stop and shop make a money order for $130, it doesn't have any payee information.

Atleast I paid for all my H1's and GC's labor like this.

it is illegal for employer to accept or ask the employee to pay the filing fee.

if the employer is not able to or willing to pay this nominal amount then i doubt if he would be able to or willing to pay you the salary.
