pay stubs and tax papers for I-485

Hi Everybody.

1. When does the employer has to start paying the sponsered employee the salary as indicated in the labor certification ?

2. The salary in my LC was 68,000 but my current salary is around 66,000. So are the paystubs that are submitted with the I-485 required to show the promised 68,000 ?

3.I was on student status in USA for three years before taking up an H-1B job and worked on college campus. But I may not have saved the W2 forms from the college years. Would I be required to get those for filing I-485?

4. Also I didn't file the tax returns (as is was optional for students) for one of those three years while I was on student visa. Does that matter ?

After your I-485 Approved

Two scenarios (In I-140 stage):

If you are working for same employer that who sponsered your GC then he has to show the proof of paying $2000 (remaining emount)

If NOT, then he has to show the proof of paying $68000

I guess you mean that in I-140 stage the employer has to show the proof of his "ability" to pay $68,000 ? Is that right ?

Also do you have an idea at what stage (if any) the immigration people would want to see the actual paystubs (or W2 or any other proof) that show the salary of 68,000 as filed in the Labor Cert ?

They can ask ask anytime if they sense that something is FISHY with the case :D otherwise. they wont ask for tax returns..
