No its expiring 5 months after the expiry of my h1-b validity....but the rule says
"A passport valid for travel to the United States and with a validity date at least six months beyond the applicant's intended period of stay in the United States. Each applicant, including children of any age, must possess an individual passport. " at http://travel.state.gov/visa/tempvisitors_types_temp_overview.html
If you are only staying here until the date on your I-797, your Passport is good enough. If you are planning on getting an extension for another 3 years, get your passport renewed NOW.
