Passport Validity ~ Need Help

Hello Everyone,
I'm wondering if you could help me answer a few questions.
I'm a GC holder, and I'll have to go back to my home country for an urgent family matter next week. The trip will only be 2 weeks long, basically from Feb. 11-Feb 25, 2005. The problem is, I was just looking at my passport, and the expiration date is Aug. 14, 2005. Now, the question, will it be a problem for me to enter the US again since the passport will be valid less than 6 months, only 10 days short from 6 months.
I'll be traveling with my husband which is a US citizen by naturalization, and my son which was born here in the US, don't know if that helps me from getting into trouble IF I did get into trouble because of the passport expiration date.
Also, second concern is that I haven't get my son's own US passport done. He's only 15 months old. He's still attach to my passport. He did travel with me last time, and I brought along his birth certificate, and we entered back to the US just fine. It's just that the officer told me that he suggested that I make his own US passport. But this trip is just in such a short notice, I won't have time to renew my passport nor apply for my son's passport since I have lots of things to take care of before we leave. Now, the questions, is there anyone that have the same experience, about how the child is attach to the mother's passport and just bringing along the original birth certificate. I'm just worried that I won't be lucky to enter as easily the second time with only birth certificate.

I have some problem we are planning to go to home country
in coming june. we will back to us in coming I first week of September.

son's passport exparation date 10/17/05.
I 551 stamp validation 1/27/06.

Is there any problems while back, even we do not have 6 months pp validation.

For yourself, all you have to provide is your I-551, Permanent Resident Card (Green card). How did you come up with the 6 months passport validity rule for the LPR?

You child's case is different. If you are travelling within Western Hemisphere (North, Central or South America), your child does not need a passport, otherwise looks like the passport is a requirement.

I guess I've been getting the wrong info from some people. Although after thinking about it, kind of doesn't make sense, unless if I try to enter with a tourist visa or something and don't have more than 6 months left in my passport.

----- better get US passport for your son, pay the extra fees and you will get the passport , many get US passport for child less than 2 month, you need birth certificate, photographs, ( i hope you are not Indian, if Indian your son needs US passport and Visitor Visa to visit India)

we hole family going to India coming June.
back to us in September.
in case of my son's I 551 valid 01/27/06
passport valid 10/17/05.

I want make sure, i can not problem at that time(reentry to us) he has only appr 30 days valid of pp?

---that is not a probem if you wish you can get new passport for him from nearest Indian consulate, I think one can apply 1 year advance or 6 months advance, check the nearest Indian consulate site

I guess no proble at POE with 1 month valid pp.

----- your son passport expires 10/17/05 and in september you all are going to be back in US, from where you will get his passport after 10/17/05 if not from Indian Consulate? you have to get it from Indian consulate or Indian Embassy DC if your son is in US and his Indian Passport gets expired, if he is in India then get it from reginal Passport in India

---No problem, but again when the kid has to visit India from US he needs Indian passport and you need to get passport for him from Indian consulate if he is in US.

what about I 551 stamping (which is in existing pp) in new passport?

----- when you get new passport the old passport copy will be returned to you with CANCELLED stamp, it does not mean that I 551 stamping or any visa is also cancelled , you need to staple both the passports, if the I 551 stamp is going to expire and you dont get the Green Card then again you need to visit local USCIS and they will stamp the passport with newI 551 stamp valid for 1 year
