Passport Renewal While 140/AOS pending

My current passport will be expiring on February 2007. Though I have 6 months but I thought of taking advice on when is the best time to go for renewal.

My AOS/I-140 is under processing at Nebraska Center. If I renew my passport -

1) do we need to provide them copies of new passport?
2) would it delay the processing?
3) should I wait until I get my EAD/APD? Any other document?

Any advice would be appreciated.

Thanks,
CoG

Even after you get your GC, you'll still be citizen of your birth country. Therefore, you'll need a valid passport. You'll have to renew your passport. I do not know the procedure for your country, you'll have to call your Consulate. You might need to go back to your country for renewal or they might ask you to go to the Consulate and sign a power of attorney for somebody in your country to do it for you. A friend of mine who has an I-140/I-485 pending just went through this exercise. He had to fly to Washington to sign a power of attorney for his parents to renew his passport. Everything went smooth.
When the time comes for the interview you should have copies of both expired and new passport. You'll be fine.

Call your Consulate. They are going to ask you about your legal status here and they'll give you instructions.

I already had my GC when I had to renew my passport (last year!). I did not have to do anything. The Consulate did it for me. I just sent the application and the passport to them and they took care of it. When you are a LPR is a little different.

Trust me! Call your Consulate. They'll help.

Good luck!

Interview????

USCIS doesn't care if you have a passport or expired passport or expiring passport. Nowadays, stamping the passport is really rare because of the fast processing of Green Card. So unless you plan to travel abroad, the passport really means nothing to USCIS during your I-485 pending or I-140.

I am speaking of myself where I had an expired passport when filed I-485 and during the AOS interview. And last year during the move, I lost my passport...

So nothing to worry about. Of course if you could renew your passport, you'd better do it before expiring from the consulate's point of view.

you must have unexpired passport at all times while in the U.S., it is one of the conditions to maintaining your NIV status

any approval for what you said?

Because I didn't have a valid passport since 2001 and my attorney told me that it was not a big deal and when I had AOS interview in the local office, the officer just looked at it and didn't say a word about it...

Thank you for your advice. Yes, I have an Indian passport. I was worried that if I need to send them copy of new passport, it may delay the processing. or renewing passport may confuse them...

Thanks again.

Buzzhd - you've mentioned that you've lost your passport. Any problems with I-485, interview, etc?

Thanks in advance
