Passport expiring before H-1B revalidation, please help

Each applicant for a visitor visa must pay a nonrefundable US$65 application fee and submit:


1) An application Form DS-156, completed and signed. Blank forms are available without charge at all U.S. consular offices;

2) A passport valid for travel to the United States and with a validity date at least six months beyond the applicant's intended period of stay in the United States. If more than one person is included in the passport, each person desiring a visa must make an application;

As mentioned in the red, does this mean, my passport should be valid 6 month beyond the H-1 revalidation duration I am asking

for example, suppose I am asking my H-1 to revalidate till Dec'2004 and my passport valid till Oct'2003, what they would do :confused: do any of you in same scenario ever.

Now one another problem, Indian embassy dont renew the passport untill 60 days before expiry date :confused:

Please help me guyz
 
You will get your visa stamp to Dec 2004 but they will not give you a new I-94. That's the situation i in now, and if anyone know of a way to get a new I-94 without leaving States?
 
kenki2u: Did you not receive the I94 back- you are supposed to receive it back. If you did not, you better visit the nearest Port of entry and get new I94. I94 determines your validity of stay.
 
jaxen: i came to States on my old H1-B visa on Feb 2001. The immigration officer gave me a I-94 with expiry July 2003 same wit h my old H1-B visa expiry date. Then i change company in Apr 2001 and my new company applied a new H1-B for me and i got the new H1-B (expiry in Apr 2004) in July 2001 but without a new I-94. INS gave me the old I-94 number with no extension; same expiry date July 2003.

I suspect it could be my passport expiry in Dec 2003. INS ruled that H1-B visa holder must have at least 6 months validity on their passport during the term of the H1-B visa.

I can renew my passport in my country embassy here. So my question here is can i get a new I-94 up to the expiry of my current H1-B visa; that's is Apr 2004 without leaving the States?

Any comment would be welcome.
