Passport Expiration

Q1.I was wondering if I need to renew my passport before the Stamping, which I am expecting anytime as per the Stats. It is expiring in March 2002.

Q2.Is there any deadline on the I-485 approval letter to get your passport stamped, since my wife\'s H1-Second Term renewal is still with the INS, and she has no renewed I-94 nor AD/PA as she never applied for it.

Q3.Can she go the INS to get her EAD if she gets her approval before the new I-94 (H1B). Let me re-phrase it,Can she get her passport stamped without current H1B/I-94/EAD. She never changed her employer since Day One and her lawyer is just beating about the bush that she should get it anytime.

1. Your passport can be renewed if it is going to expire with in 6 months. You are far away from it. Hence, you may not need renewal too. You can stamp w/o renewal.

2. Since she is covered ( I hope ) under the I-485, and if she her EAD is under process, she is allowed to work under EAD, and H1 is not mandatory.

Hence, do not worry.
