Part time job while i am in EAD as a full time emp

Hi All,

I am working for company A as a full time employee using EAD and i am in the final stage of I-485.

While i am working for company A as a consultant i was helping for company B on software development and now they wanted to pay some money every month or pay full money for last 3 months.

Is it legal to work for cpmpany B as a consult (part time), in other words is it legal to take consulting fee from this for my consulting programing as a part time job while i am on EAD????
If yes, how???

You can legally hold as many jobs as you can on EAD. Just remember that one of the jobs is in the same or similar category as the labor certification.

If it is legal, then once if i get the money from this company for my
consulting work, how would i file my tax returns?

Let us say, if this company pays $5k for my consulting work, do i get
W2 form from this company????

Because this company B is a small start up company, i am not sure
whether they have CPA/HR to generate this or not.

I am more concerned about how i can take my consulting fee from this
company B for my work???

I know this is complicated, but please let me know if you know any body who has done the same in the past.

Ravi Surya..., That doesn't look complicated to me. You can do any number of part-time jobs on EAD provided you are holding to your GC- sponsering employer or a similar job with AC21 (similar means SIMILAR here !!) That is the advantage of having an EAD.

As far as payments are concerned... You can file your taxes if you can get a 1099 or a W2 from your employerB.

Iam not a lawyer and what ever I wrote here is to the best of my knowledge....
Consult a CPA or an attorney for more details or clarifications.
