i have a full time h1 and want to apply for a new h1 for part time employment. Does anyone have any experience with part time h1s ? I have the following questions:
1. Does part time h 1 have to be for a minimum of 20 hrs / week etc ? or can it be for 10-15 hrs / week also, if it is so mentioned in my petition ?
2. Can the petition be flexible e.g. can I work 10 hrs some weeks and 15-20 hrs other weeks depending on my schedules (my potential employer is okay with that, but I am not sure about the legality from the immigration point of view) ?
3. How does wage equality apply to part time h1s ? meaning does my employer need to mention hourly wages i will get or does he need to mention the absolute annual figure for the hours mentioned on the petition ?
4. My current H1 is exempt from the cap bcos i am working at a University. the new h1 is for a for profit organization so i m assuming it will be counted toward the cap. My questions are - is the cap still open for starting work in 2005 ? and can i use portability provisions based on my current h1 to start part time work till the approval comes thru ?
