Part-time H1 visa

Hi,

I am a software engineer and my company is filing for a part-time H1 visa. It is a part-time position for around 20-30 hrs/week. I have the following questions:

1) What is the minimum legal hourly wage for part-time job? The job is in the bay area.
2) Are the visa processing fees the same as for normal H1?

Any help would be appreciated.

Minimum wage is not applicable to you job. Minimum wage for example in Michigan is 5.15.

What is applicable is 'Prevailing Wage' for your job. You can go to Department of Labor's website (search google for DOL) and check the online prevailing wage library for your job designation.

A friend had tried to get a part-time job based H1, but they raised a RFE (Request for Evidence). So make sure the job description is good.

IMHO fees are same.
