Can Parents visit if we are on EAD.. Still I didn't get my green card and my H1B is expired last year... I don't have any stamp in the passport also...

my receipt date is February 2002 and expecting green card if INS does the process faster...

also it would be great if somebody could provide all the documents we need to provide for our parents to submit in the consulate abroad to get the V-Visa, when we are on EAD with I-485 pending and H1B expired after 6 years.

Parents can visit anytime, don't have to be a permanent resident. I had my in-laws visit me, when I was just 2 years in the country H1. All that is needed is affidavit of support (I-134) and some additional documents like bank statement, letter from employer that you are still employed, letter to the consulate stating the purpose of your visit and a letter inviting your parents to visit you with a reason.

They enter only on a B-1 visa, V-visa as I understand is for someone that has already filed for family based immigration benefit (485) and has passed a certain number of days (180 days I think, not sure).

Also, include copies of the first few pages of your passport and the visa stamp. If you are waiting for your 485, include a copy of your I-485 receipt (as proof of your legal status).

My parents visas were rejected last summer at the Mumbai consulate. I was in the same situation, expired H-1 and AOS applicant. I do not know the reason for rejection but I heard through some friends that a person in this situation cannot sponsor anyone for a visa.

If anyone has any reliable information regarding this it will be really helpful (I have searched the net but to no avail)

The list of docs recommended along with the visa application includes the
following:
If child is an Indian Citizen:
a. Child's original birth certificate.
b. Photocopy of all pages (including blank pages) of child's passport.
If visa in old passport, then photocopy of old and new passport.
c. Also :
i. Where child's visa has expired but has a renewed petition, photocopy of the
renewed petition.
ii. Where child is a legal permanent resident in the USA, photocopy of the green
card.

NOTE: There is no mention of someone in between these stages - expired visa and AOS applicant!

rmdil99 - I don't mean to be discouraging but just hope that some reliable information comes along the way.

Anyone whose parents were approved for a visitor's visa when they were in the AOS stage please respond.

My parents and my In-law visited us when I was in EAD and on AOS. My parents got 10 year visa but my In-law received 1 year visa both the times she visited.

Below the documents I have sent:

1. I-134 (Affidavit of Support
2. Letter from the employer saying your position and salary
3. Copy of your I-485 Receipt
3. Copy of your EAD
4. Copy of your passport.
5. Letter to the Consulate in India stating their purpose of their visit requesting to issue the visa.
6. Letter from your Bank account to show a balance of atleast $ 7500 (Of course this is not a criteria for issuing visa) if you are sponsoring for 2 people.
7. Invitation Letter to your parents.

I have also attached the sample employement letter and Letter to consulate and invitation letter to parents (All in one Doc).
