Parents Visitor Visa -- Need advise

Hello guys,
I really need your help in my case. I can't think of anything. Let me explain my parents situation.

Back in 2001 I came here on F1 and was graduating in 2003. So I applied for my parents to attend my graduation in 2003. The graduation was on 17th of May and my parents couldn't get an appointment before 17th and got appointment for 20th May. Obviously now the reason for coming to USA was useless and they got rejected.

So I postponed my graduation to 2004 and send them another invitation letter to attend my graduation. But for some reason, they got rejected 2nd time in 2004. They tried third time in one month and this time it was canceled too. Parents were really upset and mentally broken with this. So they tried 3 times all together and they got rejected.

Mean while, I got married here to a citizen in 2006. My dad is now retired. I have filed my Green card on marriage basis. I still haven't got my GC (stupid background check). Its 2007 and its more than 3 years my parents applied for visitors visa last time.
I want to invite my parents here on visitors visa and I would appreciate any or all kind of help. My father-in-law is ready to sponsor my parents for their visit. What do you guys suggest? How can I approach to get my parents visitors visa ? I am planning to go to India in Feb with my wife. Can my wife (she is a citizen) go with my parents to the consulate for their visitor's visa?

first i am sorry to hear that you and your parents are having such problems.

from your account its quiet evident that the embassy is suspicious that your parents will not return. the burden of proof is always on you to prove they will. and aparantly they dont beleive your reasons. and as your father is retired their case is stronger.

now that you are a GC applicant the logical process is to assume you will become GC>citizen and sponser your parents to come to US. now i am sure that might not be your intention but you have to prove that its not the case. and here lies your problem.

you can try the sponsership route consult an attorney and most importantly check different fourms like immigrationportal and murthy before you apply.

personally i would wait till i get all my ducks in a row . get the GC first and apply then. if you jump the gun you might get them disbarred for 2 year.good luck

I was thinking the same. I should wait until I get my GC and then think about it. But sometimes you get frustrated and feel like "What can I do?".
 
RBJ,
It seems your parents cannot overcome 214(b). With you in the process of becoming a PR holder, it might actually get tougher for them to overcome 214(b). I would advise one of you parents to apply while the other one stays behind. If the first parent is successful in securing their visa, the second one can attempt. Good luck!!!
 
That is a good idea Triple_Citizen. I can give that a try. At least that would make the individual case stronger.
 
Exactly. If the first parent gets the visa, the second can then attempt a fresh application. The worst case, the second parent will be denied but the the first one can visit you.
