Hi,

We are planning to apply for I-130 and I-485 for my mother, can we file the papers when she is here on a tourist visa?

Please let me know the process in detail and how long before my Mother can get her GC?

If filed in the US ..about 3-4 months by current processing times. Yes, you can file once she is in the US. Wait for about 90 days after her entry to file.

Is she already here in the US? If not, she may not be allowed to enter the US with a tourist visa, if at the port of entry they realize she has a son or daughter who is a US citizen.

I am not sure what to start and where to post this. So, I ended up here to post it. Please forgive me if this is not right place.

I got my citizenship on June 25th, 2010. My mother lives in India. She visited USA twice before. Now, I want to apply GC for her. With many information I am kind of lost what to do. I got to know that I have to file I-130 form. But, I am not sure about I-485. Should I file I-485 (AOS) for her since she is not in USA now? Any step by step process would be very helpful. If I need to file anything together to make the process faster, please advice.

Any tips/links/post would be really helpful. I am lost in many documents. There are many posting for this AOS who is already in USA. But, I need the process who lives in out side of USA (i.e. Bangladesh). I appreciate your help in advance.

You cannot file the I-485 when she is outside the US. And because of you having citizenship, she may be refused entry with the tourist visa.

File I-130 with a US consulate in Bangladesh specified in question 22. That would allow her to pursue the process through the consulate.
