Parent birth certificate - born in pre-partition India

Hello All:

My father was born in Bangladesh in the 1930s, and lived in India since the age of 10. He has been using his school certificate as proof of age till now. He is an Indian citizen with an Indian passport.

For I-130/CP, he cannot get the non-availability certificate from Bangladesh, also he does not have older relatives to provide affidavits. So here are my questions:

1. Any other parent experiences - born in Pakistan/Bangladesh and lived in India? How do they get the non-availability certificate? Can I get it from Delhi - where he lives now?

2. He does not have older relatives, what are the options here? Is there a way he can use his school certificate as date of birth proof? Can I get any document from the Indian consulate here in NY?

A1: My father and mother were born in Delhi and Jhansi respectively and migrated to Pakistan in 1947. For their US and Canadian immigration, they got affidavits from surviving elders who confirmed that they were aware of their births. Both the US and Canadian authorities accepted those affidavits.

A2: If there are no living elders, then perhaps a sworn statement might do the trick. Also a document from a Bangladeshi (not Indian) consulate might do the trick.

Hi Triple citizen,

Can you please advise what is the alternative if someone is unable to get the "Non Availability of Birth Certificate" from india for parents.
