Paperwork in the wrong state, how to fix it?

Hi, Im writting on behalf of my family (mom/dad/sister). They filed their N400 in Nov 2005, they did their fingerprints within a few months of that. My dad was even scheduled for an interview in early 2006 but then he received a descheduled letter on 4/16/2006.

I have been calling the 1800 number for over 2 years and have visited my detroit office at least a dozen times. Apperantly the problem is that our paperwork ended up in California when it should have gone to Nebraska. Recently the 1800 number told us that our file is back in detroit and that we should be in the queue for interview. After a few months wait we called again and were told to go to the detroit office (via infopass) and see what they say.

Well, when we show up to the appointment, we are told that our paperwork is still in California and that they have requested the files several times. They planned on filing another request for our files.

Its getting extremely frustrating, what are our options at this point? Can we sue as others have done? Do we just wait it out? Or is there some form we can file to get this fixed?

Don't waste money by refilling. Contact congressman and USCIS ombudsman and get them involved with the case. Make sure you provide all past USCIS correspondence when you contact them.

I agree with Bobsmith. Although, from other people's experience, writing to congressmen and Ombudsman might not make CIS move your family's cases, you need to do it anyway. And it's easy to do.

Meanwhile, start preparing papers to file lawsuit. Again, from what I've heard, it's very effective, and very well might be the only way to have them work at the cases, in the situations like this one. PD 2005, for 3 people, it's extreme!
