I am nearing my 6 year limit and am waiting for my EAD through my spouse's Green Card process. I had to recently transfer from H1 - H4. A company offered me to work on a project but the pay would be in India. The company is based in US and does not have an Indian office but this is a telecommute position from India. So they will pay in India. I want to know if this is fine and what are the factors that I should keep in mind.

u cannot be in US to work for this company and get paid in India. You will have to go to India to work legally

But it is a telecommute position which means that I can work from home. So what's the difference if I work from home from India or here?

yes...I know couple of friends who were transfered to different countries for a short duration (1-3 months) paid full salary here in US and paid allowances in there...also by having H1 you are authorized to get paid here.

In your case...register a small company in India and ask your company to pay the company in india and NOT you as an individual...that would be legal as it is a corp to corp deal (outsourcing at a micro level) :)

:)

Why you even have to announce it ? I mean if you are a citizen of india then you can get paid. And if you are not paid in US, then technically you are not working.
My friends wife is on h-4 and she works for an Indian doctor as an assistant. Officially she is volunteering until she gets in to her residency.

So I do not see any problem. Unless the company here puts you on payroll or officailly claims that you are an employee. YOu could be getting training or anything else ...
