Hi,

I was asked a question (not me, as you can see by my sig) someone entered the USA with a 3 month summer visa for work+travel (not sure if that's what it's called but basically a student work program from russia) and they have overstayed over a year already..

they are wondering what there options are:

A. if they choose to leave, will they be caught upon leaving? (how do they even know they overstayed their visa without passport control?)
B. Are there any ways to legalize their stay? (marrying an american help or is it too late as they overstayed?)
C. if they leave any chance they can come back?

any help greatly appreciated..
thx

A. They will not be caught. The airline agent might notice the overstay based on the date on the I94, but it shouldn't really be an issue.
B. They can marry a US citizen.
C. If they leave any time before being granted a GC, they will have a 10 year ban.
