Overstayed on a B2 visa

My brother visited me in 2001 for approx. 8 months. His entry stamp was valid for only 6 months. Right before finishing of six months, we contacted an attorney to file for an extension. The attorney told us that it will take 6 months for INS to process this application so there is no reason to file for extension especially if my brother is going to leave within few weeks. My brother overstayed on a B2 visa for approx. 2 months and then left US.

Now, he is planning to come to US with his wife for some medical reasons and we wanted to find out if he would have any problems at the airport. His B2 visa is expiring in June/05.

His overstay has automatically voided his visa stamp. If CBP is aware of the overstay at the POE, he will be denied entry.
