Overstayed, but passport says "N/C". Parents would like to sponsor me. Need advice.

Hi, thanks in advance for any information you might be able to give me.

I’m a Canadian citizen born in the Philippines . My parents just got their U.S. greencard last year and they would like to sponsor me through a family based petition. I actually am living here in the U.S. with them since December of 2000. Now being Canadian I didn’t need a visa to enter and I know there is supposed to be an expiration for my stay. But stamped on my passport under expiration is “N/C” which I take to mean No Condition.


So, on the I-130 Petition for Alien Relative form on question #14 under “Date Authorized stay expired or will expire, as shown on I-94 or I-95” should I put exactly what is stamped on my passport? Or should I put what the law states? And I don’t have an I-94 since I came here without a visa, but being Canadian it’s understood that I’m here as a visitor so I can’t fill that part up.


Another question I have is since there is a big possibility that the immigration laws will change and having overstayed I might be able to benefit from the upcoming laws under the 12 million or so illegals staying here, should my parents file this I-130 for me before this bill passes into law or after or simultaneously?

And another concern would be if they do pass this new bill into law and it would mean I would have to leave the country and apply to get back in. Then what about my parents' petition I-130 petition for me? Plus, I have no family in Canada to stay with anymore, since they're all here.


What would be the best course of action for me? Any help or information would be greatly appreciated. Thank you so much.

I wouldn't bet on a bill that is NOT YET LAW. Besides even if that bill were to be a law today, it says something about taking 8 to 12 yrs to get a GC besides the fines etc. Are u willing to wait that long?
