Overstay married to US citizen travelling to Hawaii

advice please

New Member
My son is a visa overstay for the last 8 years or so (L2), he recently married a US citizen and has applied for his GC (the papers went in last month).

They want to travel to Hawaii in August, he has a current UK passport, (Only one year old, so no record of entry to US in it, no I94).

He will have to travel on this as he has no current US issued driving license.

My question is......As he is not leaving the US, will he have to travel through any 'check points' in the airports where he may be flagged?

His lawyer seems very blase about it all, and said he just needs to take some paperwork (receipt or something else) showing his GC paperwork has been applied for. Is this right?

I would hate to think of him being stopped and detained at Los Angeles on his return to the mainland.

Thanks in advance

Local airports should be ok. I think Passport should do as international travellers have only that??
I have travelled through LAX several times-they ask for id at entry point-just to make sure it is you I guess?

But I don't know about Hawaii-CBP has a very strong presence where I live and they can and do ask you if you are a citizen and if not to provide all valid papers. I was on a highway hugging the mexican border where they have permanent checkpoints . Don't know about Hawaii-but carry your documents just to be on the safe side. I never even knew about it until I moved to San Diego and travelled all over in the U.S without my docs.

papers..

My understanding of the law is that ICE/CBP can and do set up checkpoints with in 100 miles of the US border, all airports and transit locations. Just make sure you have your paperwork on hand.
