Overstay by 7 days

My parents have 10 year multiple entry visa. This is their 3rd visit and they have 6 months on their I94 which expires on Dec 23rd. But they could only get a return tickect for Jan 1st, so they are overstaying by 7 days. Should I apply for an extension and let ut go? Will there be problems while leaving the US on Jan 1st?

Forget it. I figured it costs less and defnitely more safer to reschedule travelling date, so went for it paying $100 rather then paying $195 to INS + all big risks.

Overstaying and not applying for an extension prior to the expiration of the I-94 will cancel the visa.

brokenarrow,

There will not be significant problems when leaving the country. No one will deny your parents to leave the country even if they have overstayed.

However if your parents plan on re-entering the country in the furture, you should apply for extension until Jan 1st or 2nd and pay the extension fees. The approval might come after your parents leave the country depending on when u apply.

If they don't plan to re-enter the US for the rest of their lives, u need not bother
